Order

A command can be an order or a precept.

Mandate , from the Latin mandātum , is the precept or order that a superior gives to his subjects. It is a provision, a resolution or a guideline that whoever is at the top of a hierarchy indicates to those who are below. For example: "I come here by order of my boss to look for the documents" , "I received an order to pick you up and take you to the office" , "Juan was fired for not complying with the manager's orders" .

The term in law

In the field of law , the mandate is a consensual contract through which one of the parties (the principal ) entrusts his personal representation or the management of his business to the other party (the agent ). The agent, therefore, takes charge of matters on behalf of the principal.

In this case, we would have to establish that there are clearly several types of mandates, among which we would highlight these:

• Based on the effect of those, they can be classified as with representation or without representation.

• If, on the other hand, the criterion taken into consideration is the object on which the mandate revolves, we would find ourselves with a special or general mandate.

• Thirdly, if we proceed to make a classification based on whether the agent acts on behalf of the principal or on his own behalf, we would have the mandate on behalf of another person and the mandate on his own account.

Obligations of the principal and the agent

Within this type of mandates, it is important to keep in mind that the two parties involved have their corresponding obligations when signing them. Thus, for example, the principal undertakes to pay the agreed remuneration or to pay the expenses generated by the other.

For his part, the agent has among his duties to carry out the actions that have been agreed upon, to personally execute the mandate and not relegate it to a third party, and also to be accountable for his actions before the principal.

It is also important to know that there are various causes that could lead to the end of the mandate. These include the fact that the stipulated period has expired, that one of the two parties has failed to comply with what was agreed upon, or that the business on which the mandate revolved has been concluded.

For religion , the mandate was the name of the rite of the Catholic liturgy celebrated at the evening mass on Holy Thursday .

This rite consisted of washing the feet of twelve men, remembering what Christ did with the twelve apostles during the Last Supper .
