The term martillero is used in several South American countries. This is what the auctioneer is called: the person who conducts auctions .

AuctioneerAn auctioneer, therefore, is dedicated to selling goods to the highest bidder . This is a professional who is in charge of auctioning, either publicly through judicial means or privately, different types of products .

In the universities of some countries, such as Chile and Peru, you can study a public auctioneer career, which usually lasts approximately 2 to 3 years. In this, students have subjects such as accounting, administration, appraisal, real estate management, legal writing, law or even legal writing.

Not forgetting other very important subjects such as financial calculation, computing, property rights, marketing techniques, ethics, sociology, registration law and topography and geodesy.

The person who entrusts an auction to an auctioneer can be the Judicial Branch (in the case of judicial auctions ), the Executive Branch ( official auctions ) or an individual ( private auctions ). The scope of this profession, however, depends on each country. In the Argentine Republic , for example, to work as a public auctioneer it is necessary to complete a university degree and then enroll in the College of Auctioneers of the corresponding jurisdiction.

In addition to conducting an auction, an auctioneer is also authorized to appraise real estate and personal property and request certificates and reports to fulfill his obligations. As for your responsibility, you must check that whoever offers something at auction has the necessary title deed; must detail the conditions of the process in writing; and must make the auctions known, indicating their name, license plate, auction location, etc.

Suppose that a judge, in accordance with the provisions of the legislation, orders the auction of the house of a delinquent individual who does not pay his debts . Sometimes, it must be taken into account that the profession of auctioneer is confused with that of runner. However, it is necessary to establish that there are notable differences between both tasks. Thus, for example, while the auctioneer is someone who acts either as an assistant to justice or by order, the broker does so privately.

In the same way, it must be established that the auctioneer carries out his actions publicly, but the broker does so privately. This without overlooking the fact that the latter has greater freedom to operate, while the other is forced to accept what is the highest offer that is made.
